It's not in the rules. It could cause conflict, but I mean, they wouldn't get in trouble for it necessarily.
If you want to have a conversation about a person in /msg that is fine but if a moderator is telling people about another's convo in socialspy then that would be abusing socialspy.

They can see your messages if they have /socialspy enabled. It's for moderating purposes not for spreading gossip.
I would probably follow the fairly common-sense rule that counsellors and doctors abide by; if they are told something private in confidence, they're honour-bound to keep it private unless it is truly endangering themselves or others. Similarly for moderators, if they witness something private said between two people in /msg and no one is in direct danger, then imo they ought to keep said thing to themselves. People shouldn't be using /msg to talk about really private things anyway, as it's not nice to burden moderators with this sort of thing, and console is always listening lol.
