    Well, the supreme court can. Lets say hillary and trump tie, and there's a recount. If the lower court takes a vote on it and it gets appealed to the supreme court, which currently has 8 justices. They can tie 4-4! I recently found out that that means the lower court ruling stands, but they can still deadlock.
