Just A Few Things Regarding "Donations"

    So, there is currently a debate whether we are donating to the server, and in return getting benefits. Or If we are purchasing intangible items.

    The fact that the store, says nothing about it being a donation, even in the terms and conditions. In my opinion makes it pretty clear we are actually purchasing intangible items (ranks and digital items)
    As shown in the wording of the bellow screenshot

    Again as shown in the below spoiler. It says that no refunds will be issued. However this is technically illegal in some countries under consumer law. Giving us the right to a refund or a replacement in the event that the goods (intangible or not) If it does not fit the product description, or If you do not receive the items, or they are faulty.



    Another point if we purchase an item, even though it is intangible you can't legally take it back, without providing compensation. Afterall it is our property, we paid for it. As shown here,


    On a last note wtf does it say on the front page of the shop that ranks carry across... When the staff team have said numerous times they dont....


    I do not endorse chargebacks, However I would like the staff to clarify on a few things.

    LOL to @everyone that said donor400 was a donation to keep the server running.

    also this makes donor400 look like a scam tbh, but you and I know they'll never fix it.

    They also said that the donor400 rank was "retired" which is bs

    so is a chargeback is technically legal if refunds are refused?
    yes, now i can chargeback a stupid server that refused refund

    Only, If you didn't get the service promised and the server, has refused to replace, or fix it

    I admire you for taking the time to do your research. However, an hour is enough to make but a cursory inspection of the veritable universe of consumer laws. That's why there are literal armies of corporate lawyers dedicated solely to studying these laws, enforcing them, and finding ways to cheat them.

    Please do some more research on whether there are different laws governing virtual/online purchases vs physical hardware purchases. I'm reasonably certain that they're very similar, but contain crucial differences which may prove or disprove the viability of the server's no refund policy. Also, if the server is hosted in a different country, all your research is invalid, since you indicated that your evidence was excerpted from American consumer law.

    I'd love to hear more about this, since I don't have the time or inclination to dig around the Internet for legal stuff.

    Doing that will either do give no response or leave the server unable to generate enough revenue to cover costs.

    If you think about it, Donor400 was never actually paid through buycraft. There are no terms and conditions except terms upon playing the server, and...paypals.

    I'm by no means an expert in law, but I do believe that the product's intangibility makes a significant difference. By this I don't mean in terms of the law--though I have no doubt this is the case--I more mean in terms of the product's reception. As an intangible product--one that can't directly be assessed and experienced by buyers prior to purchasing it--"promises" play an important role. You can't experience donor400 until you buy it, and therefor the manufacturers have to tell you what it will probably be like. It's only when these promises are broken (especially given the 'promises' of donor400 are hardly even written down--just passed from person to person) that people start to complain.
    I read these glorious few paragraphs in my search, and I really couldn't phrase this issue better myself.
    I know this doesn't resolve the issue at all--I just thought it was interesting. I also thought that it might enlighten you to how expected and common these issues are. Skyblock is not unique in its issues regarding intangible products.

    Concerning how the tangibility of the product or the fact that its a product at all changes whether or not it is a donation: no. It doesn't change anything. The Salvation Army (I assume other countries have Salvos?) for example, is a charity/not-for-profit organisation, but of course it sells tangible goods. What else would clothes be called? That doesn't change the fact that the money from the purchase of the product is being donated to a cause (in Salvo's case, to church, and in Skyblock's, to server upkeep).


    Owners haven't because they are busy, and staff haven't because they do not wish to misrepresent the owners. I've only responded with my reaction to the post, not as a statement from the staff team.

    It's a donation. As long as it states no refunds will be issued, it's legal. If you decide to charge back, there will only be more complications for you if you decide to dispute.

    We have a legal refund policy that states no refunds.

    One could argue it is a donation and you just get perks for donating. One can also say you are buying yourself an advantage in the game. This is true. I have said both.

    Digital goods and services are different. It is implied that once you purchase them you have already reaped the benefits. This fact makes them non-returnable. How can you return them? Will you return all your kits? Will you roll back your island you built with the fly command?

    Player's previous donor perks/ranks carried over from the old server to the new server.

    THe legal refund policy is illegal in my country. And as long as we are not getting the perks promised at the time of purchase. The server is pay to win, which is against the servers elua. So yeh.

    Donor400 wasn't ever for that, it was so cyp could get some more money loool - Noobcrew pays the bills, not cyp XDDD

    a bunch of the people i talked to said donor400 was "to keep the server running, you paid to keep the server alive" Idc if the server is alive i just want the $400 rank to be worth it

    A) Skyblock has the right to refuse refunds.
    It is mentioned multiple times and the consequences for chargebacks are made clear. This is especially true since it is after all a donation, you don’t just decide that you want the money you gave to your, idk school theater group, back.
    B) Tangible/ Intangible doesn’t really matter here. We buy games and software online, this is pretty much the same idea. Now, again it’s a donation, and it does say things can change, but last I checked is usually only interest of balance. Gee, that sorta sounds like a bug fix doesn’t it...
    C) The server shop is for donations, the stuff you get for donating is a bonus. Like those shirts or stuffed animals given out for irl fundraisers. You decided you liked something enough to throw some money at it, and you got something nice as a thank you.

    Did some more reading,
    According to US and EU laws , from what I as a non lawyer can tell, as long as the product isn’t defective, and is what it says it is, online stores don’t have to issue any kind of refund. Some states require that the store post that, as the server does. In essence, it’s at the shops discretion as to if to issue refunds.

    In Australia, Any company or group that offers their product in Australia, has to give refunds, if the product doesn't fit the description. Or it is faulty, in intangible or not. The rank we purchased, no longer gives you the benefits promised at the time of purchase. Again at the time of purchase the terms I agreed to, said nothing about it being a donation. And I havent had to agree to any terms changes afterwards. To use their service. Meaning the terms I agreed to are still the ones applying to me. But ehhh. Let paypal sort it out. And donations by definition is "something that is given to a charity, especially a sum of money" Without reward
