Closed Illegal to trade items

    No worries, that happens. The crux of the matter is that Drogo doesn’t think it is because gift cards are not in game items and Noobcrew might want to look at whether he can impose restrictions on their sale without violating existing laws.
    Drogo isn’t trying to stop grass for perk trade either. Only stating that having gift cards in the mix could (not have) create an undesirable situation.

    And here we stand again with, what existing law is being violated? What law do you believe noobcrew should be aware of in this instance? Please help me understand your point here. Because you came in with its “legal to sell gift cards” while I think legal or not it’s against the rules we agree to when playing on this server/ participating in this community.

    If the re-sale of gift cards is legal and set by federal laws, no server rule can overrule that.
    For instance, there are laws about expiry dates of gift cards. It would be illegal for the server to have a server specific rule that doesn’t comply with those laws.

    Perhaps a different perspective on laws and legalities should be used. For example, it’s legal for me to discuss drugs and swear, but it’s against the rules on the server. Something legal that is against the rules. We still have to follow the rules of the server even if the actions are legal.

    so even if selling gift cards for cash is legal, we still have to follow the rules of the server. Perhaps what we should be discussing more is not laws and legalities it’s whether staff/management believe the rules are stringent enough in the wording.

    This entire thread is pointless when you have/had players trading high tier rare items for thousands of dollars. And did not get ban.

    The point to this thread is that you don’t have to break rules to cash out items or grass. If they permit players to sell in game items for gift cards then those players can legally sell those gift cards because there is no rule saying that they can’t.

    This isn't exactly true. Server rules can supersede laws, as long as they don't violate the law.

    For example, the laws regarding what types of content can be hosted online are VERY lax, but skyblock is obviously much more strict about what type of content they allow than is legally necessary. Same concept applies regarding gift cards. And AFAIK, there is no federal law in the US that requires businesses to treat gift cards as valid if the terms are violated. (And in this case, the terms include not reselling for IRL money)

    I mean, you could technically "cash out" by selling Skyblock gift cards for IRL cash, but that would be extremely weird imo. If someone is going to pay you, why wouldn't they just purchase the items they were going to buy (or their own gift card) in the first place rather than spending extra money by having to round up to buy a GC?

    There would be absolutely no reason to go to a third party outside of skyblock for gift cards. I suppose you could sell them at a heavy discount but that would just result in the seller taking a loss.

    It makes more sense to trade grass directly for perks anyways, as you are losing grass by rounding up to a gift card (that will have a small leftover balance after you use it).

    I just don't see a scenario where someone would
    A) Have enough grass/eco $ to purchase gift cards on a large enough scale to turn a profit
    &
    B) Have a large enough customer base to actually be able to pawn off those gift cards for IRL cash.

    I'd say it would be more than reasonable to just outlaw sales of all gift cards in the first place, however I don't realistically see anyone having the means & resources to be able to exploit the current system either.

    There would be a few people in a position to profit in this manner. Drogo has enough grass to trade for up to $1200 of gift cards. If they were sold for $900, then that would be a tidy amount and enough to offer reasonable discounts to entice buyers.
    Drogo also has over 1 billion skybucks on Eco, with which he could do that same.
    Not that Drogo has any intention of doing this.


    Gift cards differ from content as they are purchased items, that the purchaser owns and would be also covered by consumer laws.
    Skyblock rules around selling for IRL money relate to in game or server items. Gift cards are neither of these and currently there are no rules to prevent them being re-sold. You might call on the common sense rule, but gift cards are very commonly re-sold so it would make more sense that Skyblock gift cards are no different. They are after all the property of the purchaser.

    Ranks are purchased items too, doesn't mean the buyer has rights to transfer them.

    But ranks are in game perks/ items. That’s the difference.

    I personally believe a giftcard which value can only be exchanged for said perks/items is just the same as said items. But that's just me, I know you don't feel the same.

    There is a huge gift card reselling community out there with numerous websites that facilitate reselling of gift cards.

    Gift cards have monetary value, where as perks and items don't..... or rather, they shouldn't. The fact that the server allows players to sell in game items for gift cards, means that they do as well.

    You have a point here. It would be very difficult to punish selling your skyblock gift cards on a 3rd party site. They'd obviously stop you in game if you were advertising it, but if you bought the gift card and then sold it on a website you'd probably have no punishment... Finding someone on a 3rd party site to buy a skyblock.net giftcard would be very difficult though (without advertising it in game, which obviously isn't allowed).

    Also, Drogo don't see any rule stating that we cant resell gift cards given they are not in game items.
    The trading of grass for gift cards on the other hand is clearly stated in the rules as not allowed, but the server seem to allow it.

    Just because it would be hard to catch, doesn't mean it's allowed. I personally believe if you made a discord alt and then sold gift cards to people for IRL you wouldn't get caught. You would be breaking the rules though.

    I tried to explain this earlier, I'll try again now:
    The rules state "IRL trading, "in-real life trading", is conducting a trade of ones server items for perks outside of the server, typically real life currency.". It's clear you believe gift cards aren't counted as "items" because they aren't a "physical item" in game. It's tricky wording, BUT they do count gift cards as items BECAUSE:

    "there are several items that are strictly prohibited as they go against our real life trading rule.", they refer to all the things you aren't allowed to take for server related items AS items.

    TLDR: Just because they say "item" doesn't mean they are talking about a minecraft item.

    They are items. But they are not server items. They are purchased and redeemed via a third party.

    You can put money into the server and your money becomes server items, not the other way around.
    It is the initial topic, you have a misunderstanding with the rules and want input on it, correct?
